Monday, November 5, 2012
The Muscatine County Board of Supervisors met in regular session at 9:00 A.M. with
Furlong, Howard, Kelly, Watkins and Sorensen present. Chairperson Kelly presiding.
On a motion by Furlong, second by Watkins, the agenda was approved as written. Ayes:
All.
Discussion was held with Steve Noack, MMS Consultants, regarding the timeline for the
Courthouse Landscape and Accessibility Project. Noack stated that design features, the
busy construction season and the tight time frame caused issues with prior bidding.
Noack suggested that some of the design features could be put in as alternate bids.
Noack stated that MMS would redo the preliminary design to submit for review. Board
consensus was that the project should be completed in the current fiscal year and a few
weeks before the Fourth of July. The Board directed Noack to include a late completion
penalty and alternate design features in the re-bid request.
Noack stated that MMS has incurred an estimated $3,200 in extra expenses due to the re-
bidding process. Noack asked if MMS could bring a cost amendment before the Board
for one-half of the extra expenses. Board consensus was that MMS be put on the agenda
for next week for presentation of an itemized cost amendment.
Discussion was held regarding Muscatine County Administration Building Structural and
Exterior Repairs to the Muscatine County Administration Building Project Change Order
#3. Budget Coordinator Sherry Seright stated that the Change Order was submitted
because the contractor used less brick than originally estimated, reducing costs. On a
motion by Watkins, second by Howard, the Board approved Muscatine County
Administration Building Structural and Exterior Repairs Project Change Order #3 in the
amount of -$25,541.00 for a total project cost of $474,879.00. Ayes: All.
Seright updated the Board on the progress of various projects. Seright stated that in the
future she will need to address the Board regarding public and employee parking.
On a motion by Howard, second by Sorensen, minutes of the Monday, October 29, 2012
regular meeting were approved as written. Ayes: All.
Correspondence:
Administrative Services Director Nancy Schreiber reported the Board received
notice that the County’s Hazard Mitigation Grant Application has been
approved by the U.S. Department of Federal Homeland Security’s Federal
Emergency Management Agency.
Schreiber reported the Board received notice that the City of Muscatine will hold
a public hearing on November 15
th
on proposed amendments to the Urban
Renewal Plan for the Consolidated Muscatine Urban Renewal Area.

Highway being named after only one person, the cost and height of the
Civil War Memorial, and the placement of names on the County’s War
Memorial.
Furlong received an invitation for the Board to attend the Exploring Muscatine’s
Renewable Energy meeting on Thursday November 8th.
No committee reports were noted.
Kelly attended the City of Muscatine Urban Renewal Planning meeting and also the
Muscatine Community College Strategic Planning meeting on October 31
st
.
On a motion by Watkins, second by Furlong, the Board accepted the resignation of
Robert Brooke from the Muscatine County Civil Service Commission with appreciation
for his years of service. Ayes: All.
The Board reviewed the proposed calendar for FY13/14 budget deliberations with Budget
Coordinator Sherry Seright. Kelly stated the budget requests are not limited to agencies
invited to the meetings and anyone can ask the Board for funding. Seright stated that any
agency that is not already funded should contact the Administration Office to find out
what information will be needed by the Board before it goes on the agenda. Howard
stated he does not want agencies to think the Board is prepared to give out vast funding.
Sorensen stated that he does not want to open a flood gate and it is not the Government’s
job to give away taxpayer’s money. Board consensus was to accept the calendar for
FY13/14 budget deliberations. The Board directed Seright to post the calendar on the
County’s website.
Seright stated the front entry at the Historic Jail needs repair and she has asked for three
or four estimates to replace or repair the front entry, soffit and fascia board. The Board
directed Seright to have General Services also look at the steps and the drain in front of
the Historic Jail.

The Muscatine County Board of Supervisors met in regular session at 9:00 A.M. with
Furlong, Kelly, Watkins and Sorensen present. Howard was absent. Chairperson Kelly
presiding.
On a motion by Furlong, second by Sorensen, the agenda was approved as written. Ayes:

The Board met as a Board of Canvassers for the General Election held on Tuesday
November 6, 2012. The Board of Canvassers certified the following results to be a true
and correct abstract of the votes cast in the election:
FOR PRESIDENT/VICE PRESIDENT – 19,865 total votes were cast: Mitt Romney/Paul
Ryan received 8,168 votes, Barack Obama/Joe Biden received 11,323 votes, Virgil
Goode/James Clymer received 42 votes, Jill Stein/Cheri Honkala received 48 votes, Gary
Johnson/James P. Gray received 177 votes, Gloria LaRiva/Stefanie Beacham received 3
votes, James Harris/Alyson Kennedy received 6 votes, Jerry Litzel/ Jim Litzel received
11 votes, and there was a scattering of 87 votes.
FOR UNITED STATES REPRESENTATIVE-DISTRICT TWO – 19,158 total votes
were cast: John Archer received 7,994 votes, Dave Loebsack received 10,727 votes, Alan
Aversa received 420 votes and there was a scattering of 17 votes.
FOR STATE SENATOR-DISTRICT 44 – 3,810 total votes were cast: Brad Bourn
received 1,636 votes, Thomas G. Courtney received 2,168 votes and there was a
scattering of 6 votes.
FOR STATE SENATOR-DISTRICT 46 – 13,791 total votes were cast: Shawn
Hamerlinck received 5,891 votes, Chris Brase received 7,881 votes and there was a
scattering of 19 votes.
FOR STATE REPRESENTATIVE-DISTRICT 73 – 1,372 total votes were cast: Bobby
Kaufmann received 858 votes, Dick Schwab received 510 votes and there was a
scattering of 4 votes.

cast: Scott Sauer received 9,391 votes, Stu Willits received 9,364 votes and there was a
scattering of 29 votes. Scott Sauer was elected.
FOR COUNTY BOARD OF SUPERVISORS-DISTRICT 4 – 18,870 total votes were
cast: Gary R. Allison received 8,389 votes, Kas Kelly received 10,455 votes and there
was a scattering of 26 votes. Kas Kelly was elected.
FOR COUNTY AUDITOR – 13,525 total votes were cast: Leslie A Soule received
13,333 votes and there was a scattering of 192 votes. Leslie A. Soule was elected.
FOR COUNTY SHERIFF – 15,006 total votes were cast: Dave White received 14,733
votes and there was a scattering of 273 votes. Dave White was elected.
FOR MUSCATINE GENERAL HOSPITAL TRUSTEE (SIX YEAR TERM) (ELECT
TWO) – 21,361 total votes were cast: John N. Beckey received 10,978 votes, Susan L.
Roelle received 10,275 votes and there was a scattering of 108 votes. John N. Beckey
and Susan L. Roelle were elected.
FOR SOIL AND WATER CONSERVATION COMMISSIONER (FOUR YEAR
TERM) (ELECT THREE) – 12,253 total votes were cast: Joseph Preston received 11,793
votes, Trent Barrett received 5 votes, Kyle Eller received 6 votes, Kevin Hintermeister
received 5 votes, Bill Petersen received 5 votes, Hank Priest received 8 votes, Kurt Van
Nice received 5 votes and there was a scattering of 426 votes. Joseph Preston, Hank
Priest and Kyle Eller were elected.
FOR AGRICULTURAL EXTENSION COUNCIL MEMBER (4 YEAR TERM)
(ELECT FOUR) – 34,351 total votes were cast: Monte K. Engelkemier received 7,681
votes, Lance D. Rowell received 7,648 votes, Paul Beatty received 9,819 votes, John
Lawrence received 9,100 votes and there was a scattering of 103 votes. Monte K.
Engelkemier, Lance D. Rowell, Paul Beatty and John Lawrence were elected.
FOR BLOOMINGTON TOWNSHIP TRUSTEE - 839 total votes were cast: Gary D.
Klebe received 828 votes and there was a scattering of 11 votes. Gary D. Klebe was
elected.
FOR BLOOMINGTON TOWNSHIP TRUSTEE (UNEXPIRED TERM) - 34 total votes
were cast: Tom Johanns received 2 votes, John Weaver received 2 votes and there was a
scattering of 30 votes. Tom Johanns was elected by drawing to break the tie.
FOR CEDAR TOWNSHIP TRUSTEE - 105 total votes were cast: Richard Turner
received 102 votes and there was a scattering of 3 votes. Richard Turner was elected.

FOR LAKE TOWNSHIP TRUSTEE (ELECT TWO) - 304 total votes were cast: Don
Stange received 164 votes, Clarence Finchum received 138 votes, and there was a
scattering of 2 votes. Don Stange and Clarence Finchum were elected.
FOR MONTPELIER TOWNSHIP TRUSTEE - 397 total votes were cast: Riki
Harrington received 156 votes, Maurice Strong received 238 votes and there was a
scattering of 3 votes. Maurice Strong was elected.
FOR MOSCOW TOWNSHIP TRUSTEE - 238 total votes were cast: Robert Beatty
received 235 votes and there was a scattering of 3 votes. Robert Beatty was elected.
FOR ORONO TOWNSHIP TRUSTEE - 42 total votes were cast: Jerry Murphy received
41 votes and there was a scattering of 1 vote. Jerry Murphy was elected.
FOR PIKE TOWNSHIP TRUSTEE - 184 total votes were cast: Steven Salemink
received 181 votes and there was a scattering of 3 votes. Steven Salemink was elected.
FOR SEVENTY-SIX TOWNSHIP TRUSTEE - 176 total votes were cast: Scott
Eichelberger received 176 votes. Scott Eichelberger was elected.
FOR SWEETLAND TOWNSHIP TRUSTEE (ELECT TWO) – 1,211 total votes were
cast: Richard Leach received 608 votes, Kenneth Connor received 591 votes, and there
was a scattering of 12 votes. Richard Leach and Kenneth Connor were elected.
FOR WAPSINONOC TOWNSHIP TRUSTEE - 332 total votes were cast: Brent P.
Daufeldt received 330 votes and there was a scattering of 2 votes. Brent P. Daufeldt was
elected.
FOR WILTON TOWNSHIP TRUSTEE (ELECT TWO) - 244 total votes were cast:
Melvin Bohnsack received 142 votes and Trent Barrett received 102 votes. Melvin

cast: Brandon Schadt received 7 votes and there was a scattering of 3 votes. Scott
County will declare the winner.
FOR WILTON PARK BOARD COMMISSIONER (UNEXPIRED TERM) – 975 total
votes were cast: Donald L. Drake received 965 votes and there was a scattering of 10
votes. Donald L. Drake also received 2 votes in Cedar County. Donald L. Drake was
elected.
FOR THE RETENTION OF JUDGES (SUPREME COURT):
Edward Mansfield received 9,843 affirmative votes and 3,419 negative votes.
Thomas D. Waterman received 10,219 affirmative votes and 3,421 negative votes.

FOR PUBLIC MEASURE B (CITY OF BLUE GRASS): Shall the following public
measure be adopted? For the City of Blue Grass: A local sales and services tax shall be
imposed in the City of Blue Grass, County of Muscatine, at the rate of one percent (1%)
to be effective on July 1, 2013. REVENUES FROM THE SALES AND SERVICES
TAX ARE TO BE ALLOCATED IN THE CITY OF BLUE GRASS, COUNTY OF
MUSCATINE, AS FOLLOWS: 1. 40% for property tax relief or any lawful purpose 2.
Revenues from sales and services tax are to be allocated in the City of Blue Grass,
County of Muscatine, as follows: 60% for other lawful purposes of the City. - 15 total
votes were cast: 5 votes were cast “YES” in favor of the question and 10 votes were cast
“NO” against the question. Public Measure B failed.
On a motion by Watkins, second by Sorensen, the Board ordered a recount of the
Muscatine County Board of Supervisor District Three election held on November 6,
2012. Ayes: All.

Discussion was held with Muscatine County Sheriff Sergeant Ardyth Orr regarding a
request for grant funded Sex Offender Registry Equipment. Orr stated that the equipment
is given free to the County by the Sex Offender Registry in Des Moines. Orr stated that
registering sex offenders is all done electronically. Orr stated she has requested a new
laptop, camera and signature pad. On a motion by Sorensen, second by Furlong, the
Board approved the request for grant funded Sex Offender Registry Equipment. Ayes:
All.
On a motion by Furlong, second by Sorensen, the Board authorized the request for ODCP
Interdiction Grant funding up to $3,000 (100% reimbursable, no match). Ayes: All.
Discussion was held with Muscatine County Sheriff Dave White on a request to extend
authorization for operating the diversion program seven days a week and for a temporary
part-time Corrections officer. White asked the Board to table the item until Maintenance
Supervisor Oscar Alvarez is available for input on how much maintenance will need
inmate assistance through the winter. On a motion by Furlong, second by Watkins, the
Board tabled the item. Ayes: All.
White stated his staff has found three full boxes of documents from the Veteran’s Plaza
Authority. The Board directed White to talk with County Auditor Leslie Soule and have
her decide if the documents should be kept or shredded.
White stated that the budget for transport officers is increasing due to a rise in requests
for officers to sit with mental health patients at the hospital. White stated the local
hospital does not have security staff and no longer has secure beds at their facility so
transport officers stay with the patient until a mental health bed becomes available. White
stated if a patient is cooperative and wants treatment, the officers do not stay. White
stated if a patient is uncooperative, threatening to leave or becomes violent, officers sit
with them. White stated that sometimes the officer sits with a patient for two or three
days until the patient is transferred to a secure facility. White requested that the Board
meet with Community Services Director Mike Johannsen and himself to discuss
developing a policy for dealing with this situation. Furlong stated the Board should meet
with Johannsen and White, but also invite local legislators. Sorensen said this should be
part of the mental health redesign policies. The Board directed White to talk with
Administrative Services Director Nancy Schreiber about setting up a meeting.
Discussion was held with Budget Coordinator Sherry Seright regarding Muscatine
County Jail Building HVAC Design Project – Phase 1 Change Order #3. Seright stated
that this change order is a result of the discovery of a fairly deep cistern in the geothermal
field. Seright stated the cistern was filled with two loads of 1 ½ inch stone, which took 2
1/2 to 3 hours to complete. On a motion by Watkins, second by Furlong, the Board
approved Muscatine County Jail Building HVAC Design Project – Phase 1 Change Order
#3 in the amount of $1,499.28. Ayes: All.
Seright stated that Muscatine County Jail Building HVAC Design Project – Phase 1
Change Order #4 is in the same area as #3. Seright stated the concrete parking lot has

been removed and a 40’ x 40’ area of squishy soil was discovered. Seright stated this soil
needs to be replaced before the lot is paved. On a motion by Sorensen, second by
Furlong, the Board approved Muscatine County Jail Building HVAC Design Project –
Phase 1 Change Order #4 in the amount of $3,584.30. Ayes: All.
Discussion was held with Seright on DHS Office Building HVAC Design Project – Phase
1 Change Order #1. Seright stated this Change Order is because the vault in the
geothermal field at the DHS building was relocated which resulted in fewer pipes being
used. On a motion by Watkins, second by Sorensen, the Board approved DHS Office
Building HVAC Design Project – Phase 1 Change Order #1 in the amount of -$3,729.18.
Ayes: All.
The Board reviewed the Muscatine County Infrastructure Committee Report dated April
4, 2011 with Budget Coordinator Sherry Seright. Watkins stated he wanted to review the
report to see what items have been finished and if any items need to be added. The Board
directed Seright to schedule 2-3 hours of time to review the report again and decide what
needs to be done. The Board directed Seright to schedule the review in January for one
of the Board meetings prior to the January 28

approval of Capital Projects budget
meeting.

Muscatine County Recorder Cindy Gray reviewed a bulk images agreement with the
Board. Gray stated the Recorder’s Office has agreed to provide LPS Real Estate Data
Solutions, Pasadena, California redacted document images from 2005 through October
31, 2012 for an initial cost of $16,450. Gray stated she had Muscatine County Attorney
Alan Ostergren review the agreement. Gray stated the agreement includes a $175
monthly fee for document images starting November 1st. Gray stated that the agreement
has a 30 day notice to increase the monthly fee.

Budget Coordinator Sherry Seright stated the $11,000 rebate from Muscatine Power and
Water has been received. Seright stated that MP&W gave the County the maximum
rebate for the project in part due to the efforts of Vic Amoroso, AJ Associates.

On a motion by Sorensen, second by Watkins, claims dated November 19, 2012 were
approved in the amount of $1,252,603.11. Ayes: All.
On a motion by Watkins, second by Sorensen, the following utility permits were

motion by Furlong, second by Howard, the Board approved Muscatine Courthouse
Judge’s Chamber Remodel Project Change Order #1 in the amount of $36.15. Ayes: All.
Discussion was held with County Auditor Leslie Soule regarding an application for a
Class E Liquor License and Sunday Sales Permit for Reif Oil Company, dba Stewart
Road Fast Break. Soule stated that this is a new application which will replace Reif Oil
Company’s old Class C Beer Permit and enable them to sell hard liquor. On a motion by
Howard, second by Sorensen, the Board approved an application for a Class E Liquor
License and Sunday Sales Permit for Reif Oil Company, dba Stewart Road Fast Break,
2418 Stewart Road, Muscatine, IA 52761. Ayes: All.
